Flexible working arrangements are changes to how, when or where work is performed, such as altered hours, patterns or location. Some employees have a legal right to request flexibility under the National Employment Standards, subject to eligibility. A right to request is not an automatic right to the exact arrangement proposed.
Who can make a formal request?
Eligibility depends on factors such as length and pattern of employment and the reason for the request. Caring responsibilities, disability and other specified circumstances can be relevant. Current Fair Work guidance explains the categories and how casual employment is treated.
Even where the formal statutory pathway does not apply, an employee and employer can discuss practical arrangements. Check the applicable award, agreement and policy. Do not assume a medical certificate alone triggers a particular legal entitlement.
For the Australian guidance behind this explanation, see Fair Work Ombudsman: Flexible working arrangements - Fair Work Ombudsman.
What should a request explain?
A written request should identify the proposed change and reasons. It may help to describe how the arrangement could work, including communication, hours and review. Where health information is relevant, ask what evidence is reasonably needed rather than providing an entire medical history.
A doctor may be able to describe functional limitations or health needs after assessment. They do not make the employer's operational decision or guarantee that a particular arrangement will be approved. Be accurate about duties and the effect of the condition so any evidence is useful.
How does the employer respond?
Under the relevant Fair Work process, employers have obligations about discussing requests, considering alternatives and responding in writing. Refusal must meet the applicable requirements, including reasonable business grounds. Check the current guidance for timelines and dispute options.
Doccio's online doctor service may be relevant to an appropriate health assessment, but detailed workplace reports may require your regular GP or another clinician. Confirm the service scope before booking for a specific report or accommodation recommendation.
Where to go next
Read medical certificates to understand the relevant service. A doctor decides whether a consultation, examination, referral or another pathway is appropriate for your situation.
